Dear Ms. Walden:
This letter requests that the Wisconsin Department of Natural
Resources identify all Applicable, Relevant, and Appropriate
Requirements (ARARs) for the upcoming removal action at the Kip Nelson
Properties (ABC Services) site located in Kenosha, Kenosha County,
Wisconsin. Any State ARARs identified in a timely manner for this
removal action will be complied to the extent practicable.
The United States Environmental Protection Agency has proposed to fund
a time-critical removal action to address the potential for
contamination due to approximately 300 drums, and other waste
materials, a majority of which are considered hazardous. Work is
scheduled to begin in early July 2003.
Federal ARARs for this site primarily include the Resource
Conservation and Recovery Act (RCRA) . As the wastes being dealt with
are likely to be RCRA characteristic wastes, they will be handled
accordingly. Wastes will be transported and disposed of at an
acceptable RCRA/CERCLA treatment, storage, and disposal facility
pursuant to the U.S. EPA Off -Site Rule.
